1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and LibreGuard D.O.O. ("Company," "we," "us," or "our") governing your access to and use of our VPN software, website, and related network services (collectively, the "Service").

By accessing, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

We provide software and network services that allow users to route traffic through our servers. The Service is designed to enhance network security and provide encrypted connectivity. The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

3. Eligibility and User Obligations

By using the Service, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction.
  • You have the legal capacity to enter into this agreement.
  • You are not prohibited from using the Service under applicable law.
  • You are not listed on any applicable list of prohibited or restricted parties.

You are responsible for keeping your account credentials confidential and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use and Prohibited Activities

You agree to use the Service only for lawful purposes. You are solely responsible for your actions while using the Service. You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe upon the intellectual property rights of others.
  • Transmit any material that is harassing, defamatory, fraudulent, or obscene.
  • Distribute malware, viruses, or other harmful software.
  • Engage in unauthorized access to other computer systems or networks ("hacking").
  • Send unsolicited mass emails ("spam").
  • Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, suspending or terminating the account of such violators and reporting you to law enforcement authorities.

5. Account Registration and Security

To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process. We are not responsible for any loss or damage arising from your failure to safeguard your account credentials.

6. Suspension and Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, at any time and without prior notice, for any reason, including but not limited to:

  • Violation of these Terms.
  • Compliance with legal requirements or court orders.
  • Security or technical issues.
  • Non-payment of applicable fees.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Payments, Subscriptions, and Refunds

If you purchase a subscription to the Service, you agree to pay the applicable fees and taxes. Fees are non-refundable unless otherwise required by law or explicitly stated below. We reserve the right to change our pricing at any time. Any price changes will apply to subsequent billing cycles.

Refunds are available for your first purchase only, subject to the following strict conditions:

  • Request must be made within 14 days of payment.
  • Data usage must be less than 5 GB.
  • Limited to one refund per account.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICE IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIBREGUARD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE LAST TWELVE (12) MONTHS.

10. Indemnification

You agree to defend, indemnify, and hold harmless LibreGuard and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

11. Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you consent to such collection and use.

12. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
